Is legal gender change allowed in India?
Yes. The Supreme Court's landmark NALSA v Union of India judgment (2014) recognised the right to self-identified gender as a fundamental right under Article 21. The Transgender Persons (Protection of Rights) Act 2019 provides the statutory framework and creates the Transgender Identity Certificate. A Central Gazette Notification is the universally accepted proof for updating Aadhaar (which supports M/F/T), PAN, passport, banks, and educational records.
Medical certification is not mandatory — self-declaration is legally sufficient under NALSA and the 2019 Act. If you have undergone gender-affirming surgery, medical documentation strengthens the file but is optional.
NALSA + Transgender Persons Act 2019
The Supreme Court's NALSA v Union of India (2014) judgment held that every person has the fundamental right to self-identified gender under Articles 14, 15, 19, and 21 of the Constitution. The Court explicitly ruled that medical or psychiatric certification cannot be a precondition for legal gender recognition.
The Transgender Persons (Protection of Rights) Act 2019 operationalises this by allowing any person to obtain a Transgender Identity Certificate from the District Magistrate on the basis of self-declaration. The Act also protects transgender persons from discrimination in employment, education, healthcare, and housing.
A Central Gazette Notification is the strongest single proof accepted by every institution to reflect the change of gender across Aadhaar, PAN, passport, bank, and educational records — usually filed alongside a name change in the same document.
