Mandatory Legal Process

Gazette Notification for Name Change in Passport

To legally change your name in an Indian Passport, a Central Gazette Notification is the mandatory legal instrument required by the Passport Seva Kendra (PSK). Whether you are changing your surname after marriage, reverting after divorce, or doing a full name change, the Gazette is the only proof that guarantees your application won't be rejected. Malik Advertising handles the full Central Gazette process for you end-to-end.

Post-Marriage Surname
Complete New Name

Do you need a Gazette for a passport name change?

Yes, absolutely. A Central Gazette Notification is the strongest and most universally accepted legal proof of name change in India. Whether you are changing your surname after marriage, reverting to your maiden name after a divorce, or completely changing your first and last name, the Passport Seva Kendra (PSK) requires this definitive document to process your application without endless rejections.

Self-declarations and affidavits are often rejected because they are not permanent government records. By publishing a Central Gazette, you create an unshakeable link between your old name and your new name. Once the Gazette is published, you simply apply for a passport re-issue under "change in existing personal particulars" and attach the Gazette as your primary proof.

Passport Scenarios That Require a Gazette

What Changed on 23 December 2016

On 23 December 2016 the Ministry of External Affairs announced a landmark simplification of passport application requirements. The two headline changes affecting name updates were:

  • 1.Newspaper publication removed: The mandatory two-newspaper name change publication was dropped for most passport applications.
  • 2.Self-declaration annexures introduced: A short set of prescribed annexures replaced the Gazette + newspaper requirement for common cases (marriage, divorce, minor corrections).

This reform genuinely cut costs and time for lakhs of applicants. Any agency still telling you a Gazette is mandatory for a routine passport name change is either out of date or trying to sell you unnecessary work.

Passport Key Facts

  • Authority: Ministry of External Affairs via Passport Seva Kendras.
  • Turnaround: 15–30 days normal, 3–7 days tatkaal.
  • Application type: Re-issue with "change in existing personal particulars".
  • Old passport: Cancelled and returned with the new one.
  • Police verification: Post-issue PV for most cases.

The 3-Step Gazette Process

The route we follow when a self-declaration is not enough for your case.

1

Notarised Name-Change Affidavit

Drafted on ₹100 non-judicial stamp paper stating old name, new name, complete address, father's/husband's name, and reason. For passport-specific cases we include a line referencing the current passport number and the intent to re-issue with the new name.

2

Dual Newspaper Publication

The Department of Publication (not the Passport office) requires the change to be published in one English and one regional-language daily circulating in your district. Original clippings are secured for filing.

3

Bharat Kosh Fee & Delhi Filing

Government fee paid on Bharat Kosh, digital matter prepared on CD, dossier compiled and hand-delivered at the Department of Publication, Civil Lines, New Delhi. Publication in Part IV of the Central Gazette follows within 3–4 weeks. We send you the e-Gazette PDF as soon as it goes live.

Booking the Passport Re-issue

1. Register on Passport Seva

Go to passportindia.gov.in, register (or sign in), and start a Re-issue of Passport application. Choose "Change in Existing Personal Particulars" as the reason.

2. Book a PSK / POPSK slot

Book an appointment at your nearest Passport Seva Kendra or Post Office Passport Seva Kendra. Tatkaal slots are available if you need urgent processing.

3. Visit PSK with your Gazette

Carry: printed e-Gazette copy, original current passport, Aadhaar, PAN, application receipt, and passport-size photographs. The officer scans the Gazette as the name-change proof.

4. Police verification & delivery

Post-issue Police Verification for most cases. New passport is delivered by Speed Post; the old passport is cancelled (with 'Cancelled' punched on it) and returned to you.

Passport Gazette Questions Answered

Is a Gazette Notification mandatory for a passport name change? +
Yes, absolutely. A Central Gazette Notification is the strongest and most universally accepted legal proof of name change in India required by the Passport Seva Kendra (PSK) to process your application without rejections.
Can I use a Gazette Notification for a fresh passport with the new name? +
Yes. When you apply for a fresh passport with your new name, uploading the Gazette as the name-change proof is the strongest supporting document. PSK officers accept it without follow-up.
Which is stronger for the Passport office — Gazette or self-declaration? +
A Gazette is a permanent government record and is legally stronger. Self-declarations and affidavits are often rejected, whereas a Gazette provides an unshakeable link between your old name and your new name.
How long does the passport re-issue take after the Gazette is published? +
After the Gazette is published (3–4 weeks from Delhi filing), the passport re-issue typically takes 15–30 working days for normal processing and 3–7 working days on tatkaal, plus the Police Verification window if PV is required.
Do I need to surrender my old passport? +
Yes. When the new passport is issued with the changed name, the old passport is cancelled and returned to you with 'Cancelled' punched. Some countries still ask to see the cancelled passport for old visas — keep it safe.
Can NRIs use a Gazette to change name on an Indian passport? +
Yes. NRIs can apply for a Central Gazette. The affidavit can be attested at the local Indian Embassy or Consulate; we handle Indian newspaper publication and Delhi filing.
Will old visas on the cancelled passport still work with the new name? +
Country-specific. Many countries transfer valid visas to the new passport on request; others require the cancelled passport to be carried alongside the new one. Check the specific country's rules before your next trip.
