Do you legally have to change your name after marriage in India?
No. There is no law in India that requires a woman to change her name or surname after marriage. It is a personal choice. Many women continue using their maiden name after marriage without any legal issue — and there is no procedural or tax disadvantage to doing so.
If you do want to change or add a name, you have three routes ranked by how much documentation each involves. Start with the simplest that meets your goal — you can always upgrade later.
Your Three Legal Routes After Marriage
Pick the row that matches what you actually want to achieve.
1. Add "C/O Husband"
You keep your existing name and add your husband's name in the "C/O" or "S/o — W/o" field. Update Aadhaar with the marriage certificate; every other record inherits it. Chosen by women who want to preserve professional identity while acknowledging marriage.
2. Change Surname Only
Adopt husband's surname; first name stays. Marriage certificate works for Aadhaar and passport, but banks and mutual funds often ask for a Gazette. Publishing a Central Gazette upfront saves the follow-up hassle.
3. Complete Name Change
Change both first name and surname or adopt an entirely new name. This is a full legal identity change — a Central Gazette Notification is required. Common when a new name is chosen at marriage or for astrological reasons.
Aadhaar First, Then Everything Else
After marriage, update Aadhaar first. Aadhaar is the anchor identity document in India today — PAN correction, passport re-issue, bank KYC, mutual fund KYC, EPFO, and most other systems accept the updated Aadhaar as valid proof. Updating Aadhaar first minimises paperwork downstream and eliminates most name-mismatch errors.
If you are going the Gazette route, publish the Gazette before updating Aadhaar so that Aadhaar carries the finalised new name from day one. Then everything else falls into place.
