Can I change my child's name legally in India?

Yes. A minor's name (below 18) is changed through a Central Gazette Notification filed by the parent or legal guardian. Common valid reasons include spelling errors on the birth certificate, surname alignment after remarriage or adoption, astrological/numerological adjustment, or personal preference. Once published, the Gazette is accepted by schools, boards, Aadhaar centres, and the passport office as the legal name-change proof.

Valid Reasons for a Child's Name Change

Document Alignment

Birth certificate, Aadhaar, school records carrying different names.

Spelling Errors

Hospital/municipal records recorded the name incorrectly at birth.

Surname After Adoption

Adopting parent's surname replaces the biological surname.

Parent's Remarriage

Surname change to reflect the new family unit.

Astrology / Numerology

A change advised by a family astrologer or based on numerology.

Personal / Family Choice

A conscious family decision to formally adopt a new name for the child.

Birth Certificate: Under 1 Year vs Older

For infants under 1 year, most Municipal Corporations allow a direct name update on the birth certificate itself — a much lighter process than a Gazette. This is the ideal window if the name was recorded incorrectly at birth.

For older children, the birth certificate typically stays unchanged — the Central Gazette Notification, along with updated school records, becomes the acknowledged proof of the new name across every institution.

What Gets Updated When

  • Birth Certificate: Updatable for infants (usually under 1 yr); mostly not for older children.
  • School Records: Updated via formal application to principal.
  • Aadhaar: Updated at Aadhaar Seva Kendra with biometrics.
  • Passport (if any): Re-issue at PSK with Gazette.
  • CBSE / ICSE / Boards: Board-specific correction application before Class 10/12 registration is finalised.

The 3-Step Gazette Process for Your Child

1

Parent's Notarised Affidavit

Drafted on ₹100 non-judicial stamp paper and signed by the parent or legal guardian — child's old name, new name, date of birth, address, and reason. Attested by a Notary Public. For custody cases we also reference the custody order.

2

Dual Newspaper Publication

One English and one regional-language daily circulating in your district. Ad text names the parent/guardian as the applicant on behalf of the minor. Original clippings secured for filing.

3

Bharat Kosh Fee & Delhi Filing

Government fee paid on Bharat Kosh, dossier compiled (affidavit + clippings + parent ID + child's birth certificate + photos + CD), and hand-delivered at the Department of Publication, Civil Lines, New Delhi. Publication in Part IV of the Central Gazette follows within 3–4 weeks.

Documents Required from Parent

  • Child's Birth Certificate
Anchor proof of age and current recorded name.
  • Parent's Aadhaar & PAN
    Establishes parental identity and address.
  • Child's Aadhaar or School ID (if any)
Any government-issued document with the child's current name.
  • Child's Passport-Size Photo (2 copies)
Recent, white background; cross-signed by the parent.
  • Custody Order (divorced parents)
Only if applicable — establishes which parent files.
  • Adoption Deed (adoption cases)
Only if applicable — authorises surname change.

Minor Name Change Questions Answered

Can I change my child's name legally in India? +
Yes. A minor's name (below 18) is changed through a Central Gazette Notification filed by the parent or legal guardian — for spelling errors, surname alignment after remarriage or adoption, astrology, or personal preference.
Can we change name on birth certificate? +
For infants (typically under 1 year), a direct Municipal Corporation application can update the birth certificate. For older children, the birth certificate usually stays unchanged; the Gazette Notification becomes the acknowledged proof.
Is a Gazette Notification mandatory for minor name change? +
For legally-recognised name change, yes. Schools, CBSE, ICSE, state boards, Aadhaar centres, and passport office require a Central Gazette (or, in some cases, a State Gazette) as primary proof.
Who can sign the affidavit for a minor's name change? +
The natural parent or a legally appointed guardian signs on the child's behalf. In divorce cases, the parent with legal custody signs, backed by the custody order. In adoption cases, the adoptive parent signs with the Adoption Deed.
Does the school automatically update records after the Gazette is published? +
No. Submit a formal application to the school principal along with the Gazette copy, the child's current school record, and parent's ID. The school updates records and issues a formal circular or updated documentation.
How does CBSE / ICSE handle name change for board exam students? +
CBSE and ICSE prefer the name change to happen before Class 10/12 registration is finalised. Once registered, changes are difficult. If essential later, a Central Gazette + school circular + board-specific correction application is required.
Can I change my minor child's name without the other parent's consent? +
Both parents' consent is preferred. If divorced, the custodial parent can proceed with a copy of the custody order. If one parent is deceased, a death certificate suffices. Disputed cases may need court intervention — we advise assessing the specific situation before proceeding.
How long does a minor's name change take? +
The Gazette process typically takes 4–6 weeks from start to publication. School record update usually takes another 1–2 weeks after the Gazette is delivered to the principal's office.
What if my child was adopted — can the Gazette add the adoptive surname? +
Yes. Post-adoption, the Adoption Deed authorises the surname change. The Gazette then makes it legally recognised across every document — birth certificate, school records, Aadhaar, passport.
When my child turns 18, do they need a new Gazette to keep the name? +
No. A Gazette Notification is a permanent public record. The name published when your child was a minor remains legally valid for their entire life — no re-publication is required after they turn 18.
