Is a Gazette required for property records name change?

Yes, absolutely. Sub-registrar offices, revenue departments, and municipal corporations require a Central Gazette Notification as the mandatory legal proof to update the owner's name on sale deeds, revenue records, and property tax records. It is universally accepted across every state, and without it, your application will be rejected.

Important: the original sale deed cannot be modified — it's a historical registered document. The Gazette Notification serves as the legal bridge: the sale deed retains the old name, but a corrigendum is registered linking the old name to the new name via the Gazette. Revenue and municipal records then reflect the new name directly.

What is a mutation of property? +
The process of updating revenue records (land register / RoR / khata) to reflect a change in ownership or the owner's details. For a name change (not ownership change), mutation is filed at the local Tehsildar / Talati office with the Gazette as supporting proof.
Do I need to update the sale deed itself, or just the revenue record? +
The original sale deed cannot be modified — it's a historical registered document. The Gazette serves as the legal bridge: the sale deed retains the old name, but a corrigendum is registered at the sub-registrar office linking the old name to the new name via the Gazette.
What are land records / RoR / khata / patta? +
State-maintained revenue records showing current ownership and land details. Names vary by state: RoR (most states), khata (Karnataka), patta (TN/AP), jamabandi (Punjab/Haryana), khatian (WB/Odisha), 7/12 extract (Maharashtra). All accept a Gazette Notification.
Do state-specific rules differ significantly? +
Yes. Each state's revenue department has its own portal, forms, and fees. Central Gazette is uniformly accepted, but update procedure varies. We advise the fastest state-specific route once we know your property's location.
What about municipal property tax records? +
Municipal Corporation property tax records are separate from state revenue records. Once your name is updated in the sub-registrar / revenue office, submit the same Gazette + updated records to your municipal corporation to update the property tax database.
Can I update name on inherited property using a Gazette? +
Inherited property has two separate updates: (a) succession mutation transferring ownership from deceased owner to heir (needs succession certificate / legal heir certificate, not Gazette), and (b) the heir's own name update if the heir changed their name (needs Gazette).
How long does the property record update take? +
After Gazette is published (3–4 weeks), property record update varies widely by state: 30–60 days for revenue mutation in most states; 60–120 days for combined sub-registrar corrigendum + mutation + municipal tax database update. Rural land records are typically faster than urban plot records.
Does name change affect stamp duty, capital gains, or property tax dues? +
No. Name change on records is a personal identity update, not a transfer of ownership. Stamp duty, capital gains liability, and property tax dues are linked to the property (through PAN + property ID) and remain unchanged. The Gazette simply refreshes the owner's name.
What if the property is jointly held? +
Only the co-owner whose name has changed needs the Gazette. The other co-owner's records remain unchanged. Submit a joint application to the sub-registrar / revenue office signed by both co-owners along with the Gazette copy of the name-changing owner.
